ROLLING ROAMERS TRAVEL AND ROLLING ROAMERS TRAVEL PLANNERS TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By engaging our services, making a booking, or paying any fees, you ("Client," "You," or "Traveler") agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Rolling Roamers Travel and Rolling Roamers Travel Planners ("Agency," "We," or "Us").

2. AGENCY ROLE AND RESPONSIBILITIES

2.1 Independent Contractor Services

We act solely as an independent contractor and intermediary between you and travel suppliers (airlines, hotels, cruise lines, tour operators, car rental companies, etc.). We are not the provider of travel services and do not own, operate, or control any transportation, accommodation, or other travel services.

2.2 Service Limitations

  • We provide booking assistance, travel planning, and coordination services

  • We are not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any travel suppliers

  • We make no guarantees regarding the quality, safety, or suitability of any travel services

3. BOOKING AND PAYMENT TERMS

3.1 Booking Process

  • All bookings are subject to availability and confirmation by suppliers

  • Reservations are not confirmed until full payment is received and written confirmation is provided

  • Prices are subject to change until full payment is received

3.2 Payment Requirements

  • Service fees are due upon booking and are non-refundable

  • Full payment for travel services must be received by the deadline specified in your booking confirmation

  • We accept Zelle, Apple Pay, and credit cards for planning fees. Travel suppliers only accept credit cards.

3.3 Service (Planning) Fees

Our planning service fees can vary, and sometimes there are no fees charged.

  • Service fees are separate from the cost of travel services and are non-refundable regardless of trip cancellation or changes

4. CANCELLATIONS AND CHANGES

4.1 Client-Initiated Cancellations

  • All cancellations must be submitted in writing

  • Cancellation policies of individual suppliers apply and may result in penalties

  • Our service fees are non-refundable upon cancellation

  • We will assist in processing refunds according to supplier policies, minus applicable fees

4.2 Changes to Reservations

  • All changes are subject to supplier availability and policies

  • Change fees imposed by suppliers will be passed to the client

  • We reserve the right to charge an administrative fee of $50 per change request

4.3 Supplier-Initiated Changes

  • We will notify you of any changes made by suppliers as soon as reasonably possible

  • We are not liable for changes, cancellations, or delays caused by suppliers

5. LIMITATION OF LIABILITY

5.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO YOUR TRAVEL OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF SERVICE FEES PAID TO US FOR THE SPECIFIC BOOKING IN QUESTION.

5.2 Excluded Damages

WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, punitive, or special damages

  • Lost profits, lost opportunities, or lost enjoyment

  • Damages arising from supplier failures, delays, cancellations, or overbooking

  • Personal injury, property damage, or death

  • Acts of God, natural disasters, weather conditions, or force majeure events

  • Political unrest, terrorism, epidemics, or government actions

  • Your failure to obtain required documentation or follow travel requirements

6. CLIENT RESPONSIBILITIES

6.1 Documentation Requirements

You are solely responsible for:

  • Obtaining valid passports, visas, and other required travel documents

  • Ensuring compliance with all destination entry/exit requirements

  • Obtaining necessary vaccinations and health certificates

  • Reviewing and understanding all supplier terms and conditions

6.2 Travel Insurance

  • We strongly recommend purchasing comprehensive travel insurance

  • You acknowledge that we are not responsible for losses that travel insurance would typically cover

  • Failure to purchase travel insurance is at your own risk

6.3 Accuracy of Information

  • You must provide accurate personal information for all travelers

  • You are responsible for verifying all booking details upon receipt

  • Special requests (dietary, accessibility, etc.) cannot be guaranteed

7. FORCE MAJEURE

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, epidemic, government regulations, labor disputes, or supplier failures.

8. DISPUTE RESOLUTION

8.1 Governing Law

These terms shall be governed by the laws of your state/jurisdiction without regard to conflict of law principles.

8.2 Dispute Process

  • All disputes must first be submitted in writing within 30 days of the incident

  • We will attempt to resolve disputes through good faith negotiation

  • Any unresolved disputes shall be settled through binding arbitration

8.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

9. INTELLECTUAL PROPERTY

All content, including itineraries, recommendations, and travel plans created by us, remain our intellectual property and may not be reproduced or distributed without written permission.

10. PRIVACY AND DATA

We collect and use personal information in accordance with our Privacy Policy. By using our services, you consent to such collection and use.

11. MISCELLANEOUS PROVISIONS

11.1 Severability

If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.2 Entire Agreement

These terms constitute the entire agreement between parties and supersede all prior agreements or representations.

11.3 Modifications

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website or notification to clients.

11.4 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
